In continuation of the court hearing of Air Vice Marshal Musa Umar Maisaka’s murder, which took place on November 8, 2021, Kaduna State High Court 11 has adjourned the hearing of the case to August 2, 2023 for the defendant to open defence.
During the court proceedings on Monday July 17, 2023 the state government lawyers, Barr Joseph Markus and Ibrahim Sha’aibu presented the 6th witness, Sergeant Dan Asabe Usman to testify against the said accused person, Muhammad Muhammad Giwa.
According to the 6th witness, Sergeant Dan Asabe, who’s the late AVM Maisaka’s close aide, said the accused person, Muhammed Muhammed Giwa sent an SMS to the deceased person disclosing that AVM Maisaka will be dead on the said date he was gruesomely murdered.
He added that, the late AVM Maisaka was his boss, and most of the time, he was the one in position of his phones, that informed him of the messages and calls that came through before handing over to him or going through if authorised.
Speaking to newsmen shortly after the court hearing, the government principal counsel, Barister Joseph Markus explained that they have concluded their case and are awaiting for the defendant to enter his defence.
He said, “we are doing our best and I know the court we are in the judge is a very diligent and upright judge, so we do not want to say much, but if I am to say anything about the court and the judge, he’s doing his best.
“However, the matter is still pending, we should refrain from saying a lot of things about the substance of the case or what we have done.
“We are expecting justice because we trust the process and believe in the Kaduna State judiciary and particularly this very court also and nothing but justice.” He proclaimed
While responding, the defendant’s lawyer, disclosed that they are satisfied with the proceedings, especially that the judge has granted them the audience to present their own witnesses and evidence during the next seating.
