The Action Alliance (AA) party has written the Independent National Electoral Commission (INEC), informing the electoral umpire that the party shall definitely approach the tribunals to set aside all elections conducted without its genuine candidates in 2023.
This was contained in a letter dated December 28, 2022, from Oba Maduabuci SAN and Co., to the INEC Chairman.
The party said that they had earlier submitted six judgments which have all affirmed that Chief (Barr) Kenneth Udeze is no longer a member of the party.
Two of those judgements according to the learned SAN, are of the Court of Appeal Abuja, the latest of which was delivered by the Court of Appeal Abuja on November 11, 2022.
The letter further said that, “This position that Chief (Barr) Kenneth Udeze is not a member of the party has again been emphasized by the Federal Court Abuja in a judgment delivered on the 22nd day of December 2022 in the suit: Action Alliance V. INEC, Suit Number FHC/ABJ/CS/1795/2022.”
The SAN referred to pages 10 and 11, affirming positively that Chief (Barr) Kenneth Udeze is no longer a member of the party.
” Thus, by the two decisions of the court of appeal (Exhibit Omo-Aje 1 & 3) respectively, it is conclusive that Chief Barr Kenneth Udeze is not the National Chairman of the Action Alliance.
“The said the Chief (Barrister) Kenneth Udeze having been suspended and/or expelled from the party.
” The judgment is enclosed. This is about the 6th time the commission is being informed that Chief (Barr) Kenneth Udeze is not the national chairman of the party by the courts.
“This is about the sixth time the commission is being informed that Chief (Barr) Kenneth Udeze is not a member of the party Action Alliance.
“And yet the commission continues to accord him recognition as the National Chairman of the party, a stranger to the party.
” If there is any special position Chief (Barr) Kenneth Udeze occupies with the commission, which entitles him, a total and complete stranger, to be recognized as the National Chairman of the Party, we would like to be educated.
“Let me end by reminding us that it will amount to unlawful exclusion if the candidates of the party are intentionally excluded from contesting the next general election. Unless of course it is intended that the entire process be scuttled as we shall definitely approach the tribunals to set aside all elections conducted without Our genuine candidate,” the letter read.
