Zaria: 53 Arraigned Over Unlawful Assembly

A Magistrate Court  at Chediya, G R A, Zaria, Kaduna State on Wednesday arraigned 53 people for alleged conspiracy, unlawful assembly and belonging to a gang of unlawful society.

The prosecuting officer Sgt. Mannir Nasiru told the court that the offence contravened sections 97, 100 and 197(a) of CPC.

The prosecutor appealed to the court to read out the First Information Report (FIR) to the hearing of the accused persons.

The Chief Magistrate Auwal Musa-Aliyu read as follows: “On April 15, 2017 at about 21.00 hours a team of policemen led by DSP Muhammad Lawal-Mashi arrested and brought to police station 53 persons.

“The arrested persons included; Jibril Abdullahi, Sagir Abubakar, Anas Mohammed, Mustapha Ababukar, Musa Ibrahim and Suleiman Usman among others all of various addresses,” the FIR said.

The accused persons, however, denied the allegations levelled against them.

Counsel to the accused, Yunusa Umar applied for bail of the accused persons in line with sections 35 (4) and 36 (5) of 1999 constitution as amended.

Umar lamented that the accused persons were detained in police custody for more than 24 hours contrary to section 341 of CPC.

 He said that most of the accused persons were students whom were in their tender age.

The Chief Magistrate, Auwal Musa-Aliyu, granted bail to the accused persons in the sum of N500,000 each, with one surety each in the like sum.

Musa-Aliyu said the bail would be on the condition that: each surety must present two passport size photographs, valid identity card and bank account number.

Others according to him, are letter of credence from a traditional institution, 2015 utility bill, GSM number and the surety must be a blood relation to the accused.

The Chief Magistrate adjoined the case to May 8 for further hearing.
