For allegedly disregarding its own constitution during the conduct of primary election to determine candidate of the party for Jemaa/Sanga Federal Constituency in the 2023 elections, an aspirant, Mr. Ibrahim Namadi had dragged his party, the All Progressives Congress (APC) and two others to court over the eligibility of one of the defendants.
At the mentioning of the matter at a Federal High Court in Kaduna on Tuesday October 25, other defendants mentioned in the suit are, the Independent National Electoral Commission (INEC) and
Namadi dragged them to the court to determine if the third defendant (Anto) was qualified to have participated and or to vote and be voted for in the May 27 primary elections.
The Judge, A. Shagari, adjourned the case to Nov. 18 for report on service to the second defendant (INEC) and Mr Anto Usman, as .
The first defendant’s counsel (APC), Abdulaziz Sani and that of the plaintiff, Babajide Joshua, were present at the court.
The third defendant, Anto, was alleged in the court summon to have been indefinitely suspended as a member of the APC on the Dec. 5 2021 for anti-party activities.
Namadi (Plaintiff) is therefore seeking to know the legalities behind his candidacy.
According to the originating summons sighted by our correspondent, dated September 30, 2022, was filed at an Abuja Court, but later transferred from the Federal High Court Kaduna.
It reads, “WHETHER having regard to the provisions of Article 9.3 and 21 (d), (i) and (f) of the Constitution of the All Progressive Congress (APC) the 3rd Defendant was qualified to have participated and/or to vote and be voted for in the Primary Election of the 27th May 2022, having been indefinitely suspended as a member of the said 1st Defendant on the 5th of December 2021 for anti-party activities.”
It would be recalled that the APC candidate for the Jema’a/Sanga federal constituency in the 2023 election, Mr Anto Usman was sometimes in 2021 suspended by his electoral ward leadership over alleged anti- party activities on which he refused to apologize, therefore, leaving the suspension existing.
