Chief Magistrate Court sitting at Chediya G.R.A. Zaria has fixed February 5th 2018 for the definite defence hearing and ruling on the case between C.O.P. vs Abubakar Iliyasu (Alhaji Bright) of Samaru New Extension, Zaria.
Abubakar Iliyasu Bright was standing trial on criminal charges of deformation of character, intentional insult and theft before the court contrary to Section 321 CPC.
The Judge, His worship Auwal Musa warned that, the court is only given a last chance for the defendant’s lawyer to put his house in order because the case has suffered many adjournments in favour of the defendant.
He said, the right of justice under Section 36(1) of the 1999 Constitution, that is why the court granted the application by the defendant’s lawyer Barrister G.M. Sadiq for adjournment to enable him put HUD house to order.
Chief Magistrate Auwal Musa warned that, the defendant must come to court full prepared but failure to meet up the court will close the case for fair hearing and it will fix a date for the adjournment.
The court decision on this case was due to the changes of lawyers and series of adjournment as well as the defendant Abubakar Iliyasu Bright is tactically using adjournment tricks to delay the case which is about to be concluded.
In a related case, the Chief Magistrate Court GRA Zaria has adjourned the case between C.O.P vs. Alh Yunusa Aliyu, Shuaibu and Abubakar Iliyasu (Bright) has also been adjourned to 5th February, 2018 for ruling oon the prosecution evidence.
During the proceedings, the court has admitted exhibits 1, 2, 3 and as evidence before the court, and the lawyer to the 3rd defendant Abubakar Iliyasu (Bright) Barrister G.M. Sadiq after cross examining the PW4 Insp Jonah of the Nigeria Police close his cross examination.
