Court Restrains Gov Adeleke, OSHA Others From Removing Osun  CJ, Judicial Commission Secretary

The National Industrial Court, Ibadan Division on Thursday, restrained Governor Ademola Adeleke, the Osun State House of Assembly, the Attorney-General, the Accountant General and the Osun State Judicial Service Commission from removing, suspending the Chief Judge and Secretary to the Osun State Judicial Service Commission by Justice Bola Adepele Ojo and Mr Obidiya.

Justice J. D. Peters of the National Industrial Court gave the order while ruling on the separate suits filed by Chief Judge of Osun state  and Mr Obidiya numbered NICN/IB/60/2023 and NICN/IB/61/2023 respectively at Ibadan Division.

The judge in the ruling in the motion ex parte after hearing  Oladipo Olasope SAN for applicant with O. G. lge restrained the defendants from and or otherwise tampering with the enjoyment of the Offices of the Chief Judge and Secretary to the Osun State Judicial Service Commission by Justice Bola Adepele Ojo and Mr Obidiya pending the hearing of the applications on notice of the plaintiffs.

The rulings were delivered on 15th and  November 16, 2023, by Hon Justice J. D. Peters  in in the separate suits filed by the said Chief Judge and Mr Obidiya and numbered NICN/IB/60/2023 and NICN/IB/61/2023 respectively at Ibadan Division.

“An order of interim injunction is issued restraining the Defendants by themselves or their agents or privies howsoever so—called from interfering with removing,  reversing or terminating the appointment and conditions of service of the applicant as the Secretary of the Osun State Judicial Service including but not limited to salaries and other pecuniary benefits pending the determination of the interlocutory application.

“An order of interim injunction is here issued restraining the Defendants from appointing Mrs. Abosede Fagbola to the position of secretary of the Judicial Service Commission and or giving effect to the circular issued by the Defendants dated 711) November 2023 transfering the said Mrs Abosede Fagbola to the Judicial Service.

“The 4th Defendant, Accountant General of Osun State, is here ordered and directed to continue to pay the salary, entitlements, emoluments, remuneration and other benefits and moneys the claimant is entitled to as the secretary of Osun State Judicial Service Commission pending the determination of the interlocutory application.”

Justice Peters stressed, ” Let me add because I feel it is important for me to so add that it is safe for me to and I do take Judicial notice of the obvious fact that His Excellency Governor Ademola Adeleke of Osun State is a beneficiary of the Judiciary and the Rule of Law. Thus I-lis Excellency would ensure compliance with this order by all and sundry in his administration.

” I direct that this order together with the motion on notice and all other processes in this case be served on the Defendants immediately. Case is adjourned to 12/12/2023 to hear the pending motion on notice. Hearing notice is also to issue and. be served on the Defendants with;the proof of same in the file”.
