Bauchi State High Court Number 5 presided over by Justice Aliyu Baba Usman has ordered the National Union of Bauchi State Students (NUBASS ) to pay their security man, Malam Kasimu Abubakar the sum of N1, 500, 000 over their refusal to pay his salary for a period of five years and 11 months .
Justice Aliyu Usman gave the order when he delivered judgment in a suit filed by Kasimu Abubakar against Faruk Saleh Toro and NUBASS in Bauchi.
The security man, Abubakar had told the court through his counsel, Barrister Yakubu Mele Musa that he was employed by NUBASS as a security man to work 24 hours a day since 1st February, 2012 on a fixed salary of N20, 000 per month subject to renewal and since then he was paid for three months only that is N60, 000..
Abubakar said NUBASS allowed him to move into theunion’s secretariat housing unit with his family to enable him guardtheir secretariat day and night which he did and they told him that after theexpiration of their tenure the incoming Executives may not need his service andhe agreed with all their conditions.
He explained that any time he asked them to pay him his salary, they used to tell him to be patient for they want to pay him en block with arrears.
Abubakar lived in that condition until sometimes in October 2017 when one of the official told him that they no longer need his services and forced his family out of the secretariat without notice,
The security man explained that whenever he asked them to pay his money, they refused to, a situation that forced him secured N200, 000 for his lawyer and filed a suit in court to enable him collect his money and filed a copy of his appointment letter to back his claim.
The national secretary of the union through their counsels, Abdulrashid Barau and Nasiru Abubakar told the court that the allegations made by the plaintiff is not true , because they have not at any time contracted anybody to provide security for the secretariat and he was not in possession of any letter to that effect.
In his judgment Justice Usman said after listening and considering the submission made through written addresses by the counsels to both parties, entered judgment for the plaintiff against the defendants and ordered them to pay the plaintiff his money N1,320,000 his salary and to pay N200,000 as solicitors fees and to pay N10,000 cost of action.
