Zaria Community Drags Nigerian Army To Court

Gyellesu community in Zaria Local Government of Kaduna State has dragged the Chief of Army Staff, Lt-Gen. Tukur Buratai and Commandant, Depot Nigerian Army, Brig-Gen. Christopher Musa to High Court over land dispute.

The case which is between one Ibrahim Musa and 192 others (Plaintiff) vs Chief of Army Staff and Commandant Depot Nigerian Army, Zaria (Defendant)

Mentioning the case at High Court 1, Dogarawa, Zaria, counsel to the plaintiff, Ahmed Tijjani-Abubakar said they have filed a motion on notice seeking to stop the defendant from encroaching into the plaintiff farmlands.

He said the motion was filed seeking to stop the defendants from further development of the farmlands or constructing a wall round it.

Shedding more light on the matter, counsel to the plaintiff said: “We are seeking to stop the defendant, that is the military from further development of the farmland that was illegally encroached on.

“The farmlands share boundary with Depot Nigerian Army. All these while there was demarcation but just of a sudden, the Army went into the farmlands and took them over,” he pointed out.

However, Counsel to defendants, Biola Oyebanji filed a memorandum of conditional appearance and a preliminary objection to the jurisdiction of the court to entertain the case.

In the motion, Oyebanji pleaded with the court to dismiss the case in its entirety for incompetence of the processes on the face of the case filled not the merit of the case.

Also commenting on the matter, Oyebanji said: “We are objecting to the jurisdiction of the court because of the incompetence of the processes on the face of it not the merit of the case.

“We are challenging the competence of the suit on the face of the processes served,” he said.

The presiding judge, Justice Binta Zailani adjoined the case to May 17, for ruling of the preliminary objection.
