Labourer Drags Kaduna CP, Others To Court Over Alleged Assault, Demands N200m Damages

Mohammed Nazir a labourer, at Tudun Jukun, Zaria has dragged the Kaduna State Commissioner of Police and six others to Kaduna State High Court 3, Zaria over alleged assault and  is demanding N200 million as damages. 

Other respondents in the case are the Attorney General of Federation,  Inspector General of Police, Area Commander, Zaria, Divisional Police Officer, Tudun Wada Division and  Officer Auwal.

At the resumed hearing of the case, Aliyu Hajji, Counsel for the applicant (Nazir) told the court that the case has been slated for hearing and they were ready to go-on.

However, ASP Ibrahim Mohammed, Counsel for the Police, told the court that they were not ready and appeal for short adjournment to enable the respondents reply the applicant’s application. 

The presiding Judge, Justice Rabi Oladoja adjourned the matter to Sept. 4 for definite hearing. 

The applicant approached the court on Aug.1 seeking for an enforcement of his fundamental human rights.

He sought for eight reliefs/prayers which were hinged on a declaration that the action of the respondents were in gross violation of his fundamental human rights as enshrined by the Constitution.

He also prayed for a sum of N200m as damages for the injuries, physical and psychological trauma allegedly inflicted on him by the police.

According to the affidavits attached to the application for the enforcement of the fundamental human rights, on July 25 there clash between some soldiers and police.

The clash was said to have  occurred close to where the applicant (Nazir) was packing sand along drainages, while the doing his legitimate business one of soldiers snatched his shovel and use it in the fight.

 After the clash has ended, the police raided the area, where they arrested him and took him to the Zaria Area Command office where he was detained.

On July 26, he was transferred to Tudun Wada Divisional Police Headquarters Zaria where one CPL Auwalu, Danrayya, and Nuhu Gareji  allegedly used bamboo sticks to beat him, where he was said to have  sustained serious injuries on his anus and legs.
