Impeachment: Setting Up 7-man Panel Unconstitutional – Oyo Deputy Governor

Counsel to Oyo State Deputy Governor, Engineer Rauf Olaniyan, Chief Afolabi Fashanu (SAN) has kicked against the setting up of a 7-man panel to investigate the impeachment allegations against the deputy governor by the State House of Assembly.

Chief Fashanu SAN while speaking on the setting up of the panel by the Chief Judge of Oyo State, Justice Munta Abimbola, described the decision as  unconstitutional, wrong and illegal.

According to Chief Fashanu, SAN, the decision was made in spite of the clear notice of pending appeal and application for stay of execution, saying  the CJ should have respected the judicial process in his conduct.

“The constitution of the members of the impeachment panel is unconstitutional, wrongful and illegal. It is no longer news that His Lordship went ahead to constitute the panel inspite of the clear notice of pending appeal and application for Stay of Execution”, he said . 

Chief Fashanu added, ‘ with respect to His Lordship, the Honorable Chief Judge as number one citizen in the Judiciary should have respected the judicial process”.

New Nigerian recalls that Chief Fashanu (SAN) immediately Justice Ladiran Akintola of the Oyo State High Court dismissed the suit, filed a notice of appeal and an application for stay of execution of the judgement at the Appeal court
