Court Remands, Dismisses Zazzau  Palace Guard, 4 Others For Adultery

A Magistrate Court sitting at Chediya GRA, Zaria has adjourned a case of alleged conspiracy and adultery against a Zazzau  Emirate Palace Guard (Dogari) and 4 others to February 1, 2023.

The defendants are, Ismaila Abubakar a palace guard, Hussaini Abubakar, Kabiru  Shu’aibu, Nafi’u Kabiru  and Ibrahim Abdullahi respectively.

Inspector Mannir  Nasir  told the court that it is a case of alleged conspiracy and adultery contrary to Sec.59, 368 of the Kaduna State law.

He said, on February 9, 2023 at about 8.00hrs one Mohammad Kabiru of Unguwar Kaura,  Zaria City reported to Zaria City Divisional Police that on  February 5, 2023 at about 17.00hrs, one Maryam  Jela of Bakori Local Government Area  of Katsina State went to emir’s palace to see the emir for assistance, but  was taken to Gwargwaje  and had sexual intercourse  with her,  which is contrary to Sec. 59,368 Kaduna State law.

After reading the charges to the defendants, the 1st defendant, Ismailia Abubakar a palace guard admitted committing the offence, while the second, third, fourth and fifth  defendants denied committing the offence.

The Prosecutor applied for a date for summary trial to the 1st defendant Ismailia Abubakar since he admitted committing the offence while the second, third, fourth, and fifth defendants, who denied committing the offence, applying  for a date for them to prove by providing their witnesses.

Counsel to the defendants, Barrister Abdulmumini Ishaq  did not object the prosecution application but  applied for the second, third, fourth and  fifth defendants’ bail under Sec. 86(5) 375 ACJA.

Barrister Ishaq  said only the court has the jurisdiction to grant bail and assured that his client will not jump bail if the application is granted.

The prosecutor objected the defendants’ counsel bail application on the ground that the case has society attention.

Chief Magistrate Abubakar Aliyu Lamido  adjourned the case to February 1, 2023 for rulling  and summary trial for the first defendant, Ismailia Abubakar and ordered for the remand of the defendants at the Zaria Correctional Facility.

Earlier, the Zazzau  Emirate  issued a statement on Tuesday, signed by the Emirate Public Relations Officer, Abdullahi Aliyu Kwarbai announced the dismissal of Ismailia Abubakar from the Palace Guard (DOGARI) over the allegation.
