Legal luminary, Chief Yomi Alliyu (SAN) on Saturday, was optimistic that the Federal High Court judgement voiding Gov Adegboyega Oyetola’s nomination as All Progressives Congress (APC) governorship candidate in the July 16 election, won’t affect the sitting of the state election petition tribunal.
Chief Alliyu (SAN) stated this during a chat with the New Nigerian on the Federal High Court judgement on the nomination of Governor Oyetola as Osun state APC governorship candidate for the last July polls.
According to the legal luminary, Governor Oyetola will be filling an appeal on the judgement of the Federal High Court on Monday, “by all means” .
” I was in total disbelief on hearing the news that the Federal High Court held that Gov Oyetola’s nomination was void! The law sits on its head whenever election is around! . However, JEGEDE v. AKEREDOLU CASE has shown that this is just a storm in a teacup”, he said.
Chief Alliyu (SAN) added, ” the appeal should be filed on Monday by all means. However, the judgment does not affect the Tribunal since the FHC and Tribunals are deemed in law to have equal power being Courts of coordinate jurisdiction.”
” Preliminary objection to the petition, if filed as it will, will also not work cos the Tribunal by law must hear both the petition and the objection together and by law it is mandated to give judgment on both on conclusion of the petition. So no cause for alarm.”
