Lawyer accused of husband’s murder to be re arraign in High court tomorrow

The female lawyer with the Oyo State Department of Public Prosecution, Yewande Oyeniran, presently remanded at the Agodi prison custody is to be re arraigned tomorrow before an Oyo State High Court for allegedly killing her husband, Lowo Oyeniran , at Akobo area of Ibadan on Tuesday, February 2, this year.
New Nigerian reliably learnt that the murder case has been transferred to the state High Court, though it was mentioned for hearing at a Chief Magistrate Court sitting in Ibadan with Chief Magistrate Mrs Kehinde Durosaro-Tijani adjourning it till March 1, 2016.
At the mentioning of the case today, the Police officer investigating the alleged killing of Lowo by his wife, Amos Adewale, informed the Court that based on legal advice from the state, the Chief Magistrate Court lacked the jurisdiction to hear the case.
However, there was a drama at the Chief Magistrate Court, when the female lawyer was brought into the court with a veil covering her face.
On sighting the female lawyer in veil, the family of her late husband raised eyebrow berating the covering of her face by the prosecution team. But Counsel for the accused, Barrister Oluseun Abimbola, said there was nothing wrong in protecting the female lawyer by covering her face.
According to Barrister Abimbola, “as you observed, the proceeding today was just for mention, basically for the prosecution to report the state of legal advice from the state to the court. That was what they did”, saying, “there was no complaint from Adesiyan about the covering of Yewande’s face in court. Maybe it’s a personal opinion of the individual. It is not wrong to cover one’s face in court.”
However, counsel to the family of the Late Lowo Oyeniran, Barrister Kehinde Adesiyan said the covering of the female lawyer’s face in court could be likened to a masquerade appearing before a court, saying, “a masquerade is not a juristic person before the court”.
“The covering of Yewande’s face is unknown to law. It is alien to our jurisprudent. It is just like a masquerade appearing before a court. A masquerade is not a juristic person before the court. We did not raise the eyebrow on this today because we know that the court lacks the jurisdiction to hear the court. When we get to the High Court, I am sure she will not be able to do that,” he said.
Emphasizing that an accused person could be protected for fear of being molested by the public, Barrister Adesiyan maintained that it was wrong to shield the accused face in the court.
The female lawyer was later returned to the Agodi prison in a prison van marked PS 638 A01.
