High Court Upholds Representative Suleiman’s Election

Federal High Court sitting in Kaduna yesterday dismissed the suit brought before her challenging the victory of Honourable Samaila Suleiman representing Kaduna North Federal Constituency for lack of merit.
In a suit number FCH/KD/CS/64/2015, against Honourable Suleiman and 2 others, Usman Shehu Bawa said the ‎46 of the congress men that voted for the 1st defendant are civil servants who are not eligible to vote and hence the votes should be deducted and he be declared as the winner of the primary.
But in her judgment, the presiding judge, Justice Evelyn N. Anyadike‎ rules that, “assuming but without conceding that the plaintiff has proved that 46 out of the congress men are civil servants and that they took part in the primaries, having accepted that the votes were cast by secret ballot, the plaintiff has failed to prove that all the 46 civil servants voted for the 1st defendant and that none of them voted for any of the other candidates at the said primaries.
“There is no yardstick placed before the court to determine which of the ‎voters voted for any particular candidate.
“This issue is resolved in favour of the 1st and 2nd defendants. On the whole, the plaintiff has failed to prove that he is entitled to the relief sought. The suit is without merit and is hereby dismissed.”
