The State High Court sitting in Kaduna has ordered Kaduna State Urban Planning and Development Agency, KASUPDA and its agents from building on Senator Suleiman Hunkuyi’s plot of land at No 11B Sambo Road, Kaduna purportedly seized by the state government on the alleged non-payment of ground rent.
It will be recalled that the Government of Nasir El-Rufai early this year demolished Senator Suleiman Hunkuyi’s house at No 11B Sambo Road in Kaduna which Kaduna Geographic Information Service (KADGIS) claimed was done for non-payment of ground rent. KADGIS said it had revoked the land and handed over it to KASUPDA for building of children park.
Dissatisfied with the action of the government and its agencies, Hunkuyi through his lawyer Prof. Dankofa Yusuf approached the Kaduna State High Court to ask for compensation and hurt further actions on the property at 11B Sambo Road. The Court then on March 15, 2018 gave an interim order restraining Kaduna State Government, KADGIS and their agents from taking further actions on the property including doing any harm to boys quarters which survived the demolition of 20thFebruary, 2018. The boy quarters had since been pulled down with KASUPDA already erecting structures on the plot of the land.
However, the court in the case with Suit No KADH/KAD/777/2018 between Manu Investment Ltd andKaduna State Urban Planning and Development Agency, in an Order of Interim Injunction “restrains the Respondents, KASUPDA and its agents either by themselves, assigns, or any other person directly or indirectly engaged by them from trespassing and erecting any further structure on property situated at No 11B Sambo Road Kaduna which rightfully belongs to the Plaintiff pending the hearing and determination of the Motion on Notice.”
The court which gave an order upon a motion exparte brought pursuant to Order 15 Rule 1 of the Kaduna State High Court Civil Procedure Rules 2007, adjourned the case to 23rdOctober, 2018 for mention.
