The Osun State High Court sitting in Ikirun on Monday adjourned the legal battle over the leadership of the state chapter of the Peoples Democratic Party, (PDP) till November 25th this year.
The Court also converted its interim order to preservative order in favour of the court reinstated state Chairman of the party Honourable Olasoji Adagunodo.
At the resumed hearing of the suit after all appearances were announced, the defense counsel, Barristers  Dosu Babatunde for the 1st Defendant (PDP), Yemisi Anintejuwa for the 2nd defendant( Mr. Sunday Bisi), Yemi Ibrahim Abolusodun for the 3rd Defendant( Mr. Sunday Atidade) and Jola Akintola for the 4th Defendant( Prince Bola Ajao) replaced their earlier filed applications with a new one which was subsequently filed before the court .
The Applicant counsel told the Court that since the defendants counsel just filed their applications, there will be the need for an extension of time for him to reply to the new applications.
However, the defense counsels asked the court to strike out the interim order granted the applicant to resume as the validly elected chairman of PDP.
They averred that  counsels to the defendants the interim order has expired immediately a motion for objection is filed against it and that it has only seven days
Counsel to the applicant, Honourable Olasoji Adagunodo, Barrister Edmund Z. Biriomoni asked for validation of the interim order as all the seven requests/prayers of his client were all considered and appeared reasonable because he was removed in abeyance to the provisions of the constitution of PDP.
Barrister Biriomoni argued further that the defense counsel failed to prove that the interim order has expired and that the interlocutory interim order has not expired because Sunday is not part of the days being calculated to make it 7days
Justice Jide Falola however stated that it is not possible to allow vacuum to exist in the structure of the party therefore  converted the interim order granted Hon. Olasoji Adagunodo to a preservative order for him to continue to enjoy his status as the validly elected chairman of PDP in Osun state pending the determination of the motion on notice.
Justice Falola then adjourned the case till 25th November, 2020.
