Kaduna State Government’ has challenged the jurisdiction of the Kaduna State High Court 1 to hear and determine the case filed against it over the appointment of Emir of Zazzau, Ambassador Ahmed Nuhu Bamalli.
Mr Sanusi Usman, Director Civil Litigation, Counsel to the government brought up the challenge at the Kaduna State High Court 1 sitting at Dogarawa Zaria at the resumed hearing of the case on Tuesday.
It would be recalled that Alhaji Bashar Aminu (Iyan Zazzau) instituted the case against the defendants challenging the process of the appointment of Ambassador. Ahmed Nuhu Bamalli as the new Emir of Zazzau following the death of Alhaji Shehu Idris.
Usman represented the Governor of Kaduna State; Balarabe Lawal, Secretary to Kaduna State Government; the Attorney General of Kaduna State; and Jafaru Sani (Commissioner for Local Government and Chieftaincy Affairs Kaduna State) in the matter.
Others defendants in the matter are Kingmakers of Zazzau Emirate, Ibrahim Aminu (Wazirin Zazzau); Alhaji Umar Mohammed (Fagacin Zazzau); Alhaji Muhammad Abbas (Makama Karamin Zazzau); Alhaji Dalhatu Kasim (Limamin Jumma’an Zazzau) Alhaji Muhammad-Sani Aliyu (Limamin Kona Zazzau) and Amb. Ahmad Nuhu Bamalli.
Counsel to the Plaintiff, Ustaz Yunus Usman, (SAN) said the business of the day was argument in motion of interlocutory injunction filed before the court.
Counsel to the Kaduna State Government’ said they have filed preliminary objection challenging the jurisdiction of the court to entertain the matter.
Usman therefore, applied for an adjournment which was conceded by the Plaintiff and other respondents.
The presiding Judge, Justice Kabir Dabo adjourned the matter to November 2 for hearing the preliminary objection filed by the state government.
Also, it would be recalled that on the last adjourned date October 19, the plaintiff, Alhaji Bashar Aminu (Iyan Zazzau) moved an ex-parte motion through his counsel, Mr Sam Attung
The application was praying for the Court for an order of interim injunction restraining the Governor of Kaduna State (the first defendant) from installing, crowning recognizing and dealing with any person whosoever as the Emir of Zazzau.
The applicant also prayed the court to stop the Governor from performing or executing any ceremony for the purpose of installing any person as Emir of Zazzau pending the hearing and determination of the motion on notice.
The application prayed for an order of interim injunction restraining the 11th Defendant, Amb. Ahmed Nuhu Bamalli (the Emir of Zazzau from parading himself as the Emir, pending the hearing and determination of the motion on notice.
The Presiding Judge, Justice Kabir Dabo ordered that all defendants should be served with motion on notice and originating process filed on the case.
Justice Dabo also ordered that the respondents be given six days upon service of the process on them to respond on the application by the plaintiff.
