The National Governorship Election Petition Tribunal sitting in Yola, the Adamawa State capital on Friday upheld the election of Governor Ahmadu Fintiri of the People’s Democratic Party (PDP).
Delivering it judgment, the tribunal, headed by Justice Adediran Adebara, dismissed the petition filed by the All Progressives Congress (APC) challenging the election of Fintiri on the March 9th and 29th, 2019 governorship election.
According to him, the APC petition lacked merit, citing that it was incompetent since Bindow Jibrilla, candidate of the APC, who should benefit from its outcome, was not joined as a party to the suit.
The tribunal held that the petitioner failed to prove the allegation of over voting, non voting and non compliance with the electoral act.
The judge maintained that even the witnesses of the petitioner APC were inconsistent in their submissions.
He, therefore, dismissed the petition and affirmed the election of PDP’s Fintiri as winner of that exercise.
Barrister Leonard Zadon, counsel to the respondent, described the judgment delivered as a victory to law, stressing that the victory was not only for PDP.
The Counsel to the Petitioner (APC), Mr Ibrahim Efiong, said that although their petition was dismissed, they would study the judgment to determine their next line of action.
