Justice Hadiza Shagari of the Federal High Court Katsina has fixed October 30, this year for continuation of hearing on the alleged five billion naira fraud against the former Governor of the state, Alhaji Ibrahim Shehu Shema.
Former Governor Shehu Shema was dragged to the Federal High Court in Katsina jointly by Katsina state Government and Economic and Financial Crime Commission (EFCC) for alleged misappropriation of five billion Naira Subsidy Re – Investment Programme (SURE – P) funds.
The Federal High Court at its resumed sitting on Tuesday, the leading defence Counsel Mr Elisha Kura (SAN) told the Court that,his Client, Alhaji Ibrahim Shehu Shema has withdrawn the intention of filing a motion before the court.
Mr Kura said the intended motion was that of challenging the jurisdiction of the court to entertain the alleged fraud case filed jointly by EFCC and Katsina State Government before the Federal High Court. Mr Elisha Kura reiterated that, they resolved to withdrew their intention based on the reaction of the prosecution on the matter and doubting the substance of the motion.
The Ibrahim Shehu Shema’s led defense counsel, Mr Elisha Kura (SAN) announced the return of documents released to their Client which enabled him travel abroad for Medical trip as requested and granted by the court. Consequently, the presiding Judge, Justice Hadiza Shagari adjourned the case to October 30,2019 for continuation of hearing.
Justice Shagari said the adjournment date was as a result of consensus reach by both Prosecution Counsels led by Mr Sam Ologunrisa (SAN) and the defense counsels led by Mr Elisha Kura (SAN) respectively.
New Nigerian gathered that, prosecution is expected to present its witness for cross examination during the next sitting.
