All Progressives Congress (APC) stakeholders in Oyo State under the auspices of Unity Forum on Thursday asked the state Independent Electoral Commission (OYSIEC) to obey the court order stopping the conduct of the planned May 12 local government election in the state.
The APC Unity Forum handed down the warning in a statement made available to newsmen in Ibadan by its Secretary, Dr. Wasiu Olatunbosun following claims by OYSIEC that there was no court order stopping the election.
According to the APC Unity Forum Secretary, there is the need for OYSIEC to consider the consequences of such attempt which “could be tantamont to undermining the authority of the judiciary, which in itself is contemptuous”.
“The Unity Forum of APC has condemned the state government and Oyo State Independent Electoral Commission ( OSIEC) over a statement credited to the commission that no court judgment can stop the forthcoming election.
This provision is contrary to section 5 of the constitution which gave adjudicatory powers to the court. Any provision which tend to oust the powers of the court, especially state law, which is inferior to the constitution, the ground norm, shall to the extent of its inconsistency, be null and void, and is of no effect. This is trite.”he said .
Dr Olatunbosun added that “here was no place in logical or legal reasoning that places state laws over the constitution of the Federal Republic of Nigeria”, saying, the statement by OYSIEC was “not only unfounded but also reckless and unbecoming of a legal luminary in lawyer Ajeigbe OYSIEC Chairman status”.
” The Ajimobi led administration twice postponed the said election due to court injunctions. Why did government is now trying to ignore the court order as this would be tantamount to speaking from both side of once mouth.”
The APC Unity Forum however urged the people of the state to disregard the threat by OYSIEC to disobey the court order as “all legal means would be pursued to bring sanity into the system.” saying, “all hands must be on deck to put a stop to political rascality and impunity in the state”.
