Multi billion naira loan: Court dismisses suit against Gov Abubakar

State High Court 4 sitting in Bauchi Wednesday dismissed a suit against Governor Mohammed Abubakar of the state for allegedly securing N4 billion loan from United Bank for Africa without the approval of the State House of Assembly..
It could be recalled that a citizen of Bauchi state, Alhaji Nasiru Darazo instituted the suit against Governor Abubakar.
In the suit number BA/258/15, Darazo was seeking for the determination of whether the Governor has the power within the provisions of section 128 and 129 of the 1999 constitution as amended to source for, collect and utilize the N4bn on behalf of the state without due approval of the State House of Assembly.
Delivering his judgment, Justice Hamidu N. Kunaza said that the plaintiff lacks the locus standi to file the suit as he also lacks competent evidence to support his claim that the loan facility was collected, but rather quoted a newspaper which is not admissible before the court
While responding to the judgment, counsel to plaintiff, Barrister Dahiru Mohammed Bello said “We are satisfied with the ruling, we are therefore heading for appeal, in fact we have put all necessary documents for the appeal.
According to the counsel, the ruling lacks merit because his client has the right to question the Governor on how tax payers money is utilized.
Counsel to the defendant, Barrister Abdullkadir Kabiru Maunde expressed satisfaction for the ruling, saying the respondent has no clear evidence to challenge Governor Abubakar in court of law because he only got his information from newspaper pages where stories are on hearsay and not tenable before the court .
Meanwhile, the plaintiff, Alhaji Nasiru Darazo said “I am not really satisfied with the ruling therefore we are heading for appeal soonest”
