Minanta Estate demolition: Plot subscribers in court over refund

Subscribers of  plot/ housing units  at Minanta Estate located at plot 119, Lokogoma district Abuja have dragged the estate owner to court for a refund of about 46.5 million Naira.
The company’s clients through the agent -Bamiday Properties Limited  instituted the action at the FCT High Court Abuja.
They have  asked the court for an order directing Minanta estate limited to refund the sum of 46, 550,000 Naira being money collected from them as subscription for the plot/housing units at the estate.
The plaintiff also asked for an order of the court directing the defendant to pay ten percent interest on the sum until liquidation of same.
In a 21 paragraph affidavit in support of the suit and deposed to by Mr. Ifedayo Ajayi the Managing Director, Bamiday Property Limited, the subscribers stated that Minanta Estate limited is the owner of Minanta Estate located at plot 119 Lokogoma District,Abuja
That sometimes in March,2011, the plaintiff  through its Chairman, Alhaji Ahmed Tijani Umar , engaged the defendant as its agent to , on her behalf the plots/ housing units.
Based on the instruction the defendant marketed the plots to them at various prices and that the sum of 46.5 million Naira as  proceeds of the sale was remitted to the defendant.
That after the payment was made by 18 subscribers and work on their houses in progress at various stages of completion, officials of the Federal Capital Territory Administration stormed the estate on July 21, 2012 and demolished the houses.
He claimed that when the subscribers demanded the refund of their money after the incident the estate owner pleaded to   re allocate them another plot.
That despite several correspondence the estate owner has failed to honour his pledge,rather issued two dud cheques.
The case has however, been adjoumed to Febuary 6, 2013 for further hearing.
