Deposition: Ba’ale Drags Olubadan, 3 thers to Court, Demands N2million Damages

The Olubadan of Ibadanland, Oba Saliu Adetunji was on Wednesday dragged to court by the baale of Olode in Oluyole Local Government Area, Ibadan, Chief Lukman Ilufemiloye Alao over his sack from the traditional stool by Oba Adetunji.
Chief Alao in a motion on notice filed by his counsel Barrister Saani Oyedele is also seeking N2milion as general damages for the pain, embarrassment degradation he suffered over his “unlawful deposition by the Olubadan”
In the motion,Chief Alao who joined the Olubadan-in-council, Oluyole Local government, and the new baale Mr. Dauda Odeyemi as co-defedants in the suit challenging his purported removal from office prayed the court to grant a perpetual injunction restraining Odeyemi from parading himself as the baale ‎of Olode”
Chief Alao stated in the in motion on notice that the meeting held on the 9th January 2017 was not properly constituted and that it breached all principle of fair hearing as he was not given any petition written against him nor was he heard by the Olubadan-in-council ‎before the decision to remove him and install a new baale was taken
While praying the court to declare ‎“the January 7, 2017 meeting as ‘ultra vires’ as he was not given the opportunity to defend himself on any allegation made against him” and that his purported deposition was “unlawful, null and void” as the stool of Baale Olode was not vacant and he still remained the baale of Olode
He also claimed in the motion on notice that the new baale of Olode‎ was not qualified to occupying the position as he was not a member of the Olode chieftaincy family
Chief Alao in his statement of claim stated that he was installed the baale on December 3rd, 2007 and that the Baale Olode chieftaincy stool had been rotated for time immemorial between the families of Odegbero and‎ Aborisade,claiming that the father of the new baale, the late Chief Olayiwola Odeyemi Ejo, who was his immediate predecessor, was removed in 2007 ‎because he is not from any of the entire chieftaincy families but from “a small village called ‎Ejo which was about 10kms away from Olode town”
No date has been fixed for the hearing of the case.
It will be recalled that Chief Alao was removed from office on Monday January 9, 2017 and a new baale appointed and sworn-in immediately by the Olubadan.
