Reports reaching New Nigerian Online have it that fifty Family Courts inaugurated by former Governor, Emmanuel Uduaghan have suddenly disappeared in Delta State.
One hundred and four family court Assessors sworn-in also inaugurated at the same time are not sitting in the thirteen Local Government Areas.
This was contained in a letter sent to the Delta State Chief Judge, Justice Marshal Mukoro by the Proprietor of Explosives Academy in Abraka Community in Ethiope East Local Government Area, Ighorhiohwunu Aghogho.
The letter was allegedly received by one Chukwuma Jenniffer on 22/2/18 attached to the Delta State Chief Judge’s Office,Asaba.
In the letter, Aghogho applied for transfer of the case which is under litigation to a duly constituted court.
“My institution, Explosive Academy Abraka can only function by accessing the Delta State Family Court both at the High Court and Magistrate Court level.”
“I humbly apply for the transfer of the aforementioned cases to wit: Ighorhiohwunu Aghogho&1or vs. Inpector General of Police &1or,suit number HCA/8f/2018 Holden at the high court of Justice Agbarho and Ighorhiohwunu Aghogho &6ors Suit number w/41/17 Holden at the high court of Justice Warri to a duly constituted family court sitting in delta state.”
“That the High court holden at Agbarho decline jurisdiction to hear the said case when the matter came up for hearing on 19/2/18 while the court sitting at Warri has been sitting as a high court without jurisdiction to hear the case.”
In a response, the Delta State Chief Judge,Justice Marshal Mukoro has acknowledged the letter of Explosives Academy in Abraka.
In a letter signed on behalf of the Chief Registrar of Department of Court Administration/Litigation by a Deputy Registrar F.E. Esiso(Mrs.) which same was obtained by New Nigerian, the Chief Judge said he had written to the Delta State Commissioner for Women Affairs and Social Development to forward to his Office the names of the Family Court Assessors to enable him carry out further actions on the matter.
Part of the letter reads thus;”I am directed by the Hon. Chief Judge to acknowledge the receipt of your letter dated 22nd on the above subject matter.
“I am further directed to inform that the Office has written the Commissioner for Women Affairs and Social Development to forward to this Office,the names of the assessors to enable the Chief Judge further necessary actions.”
