Court Discharge ABU Staff of Criminal Allegation

The Chief Magistrate Court sitting at Kings road, Sabon Gari Zaria has discharged Joy Enobong Akpan of Ahmadu Bello University (ABU) Zaria on the allegation of criminal deformation, injurious falsehood brought before the court by five persons seeking redress.
Delivering the ruling, Chief Magistrate Benjamin Hassan said having gone through the evidence adduced by the complainants, no Prima Facie case has been made out against the accused and discharge her of the offence by virture of section 159(1) of the CPC.
The Judge said counsel referred to section 391(1) and 391(2) of the penal code law submitted that the accused person is covered by the exception.
He also referred to section 122 E. A and asked the court to take judicial notice of the proceedings that all the prosecution witnesses said the defamation statements were made before the ABU Security Unit which her counsel further submitted that it is not an offence in law to do what the accused person did and referred to section 291(2) of the Federal Republic of Nigeria constitution as amended.
Chief Magistrate Hassan said no case submission can be made and upheld no evidence adduced by the prosecution, discredited as a result of cross examination that no reasonable tribunal could safely convict.
The complainant are Mohammed Gimba Alfa, Rev. J. F. Buka, Lawal Yakubu Hunkuyi, Mohammed A. Yunusa and Haruna Mohammed have testified after which the counsel to the accused person Barrister Aminu Adamu filed a no case submission.
